The ground

The DOGAMI compilation of Yeats and others (1996) assigns 100 percent of the property, 205.4 acres, to the Tyee Formation (Tt), an Eocene marine turbidite sandstone unit, and carries the compilation's own caveat that it is not for legal, engineering or surveying use.2 The Polk County soil survey records map units 55D (Peavine silty clay loam, 3 to 30 percent slopes), 55E (Peavine silty clay loam, 30 to 60 percent slopes) and 34D (Honeygrove silty clay loam, 3 to 25 percent slopes), each flagged as not prime farmland, with Sep 8, 2026 as the record date.3 The SGMC state-scale compilation (Miller and others, 2002, scale 1:500,000; Horton, 2017) places the Tyee Formation (Tt, Middle Eocene sandstone) on the property, but its stated use scale is about 1:1,000,000 or smaller, so this on-property assignment cannot be relied on at parcel resolution.4 The same state-scale source maps Qal, Qls, Qs, Ti and Ty within the township, each marked as not on the property; these are regional context only and should not be read as occurring on this land.5

Pedee, less than a mile from this land (Geographic Names Information System, as retrieved for this report), sits on the Luckiamute River (U.S. Geological Survey site 14190000, "Luckiamute R at Pedee Oreg") [11]. The people of this river were the Luckiamute, one of the Kalapuyan nations of the Willamette Valley; Zybach writes "Luckymute (or, Luckiamute)" and Lewis "Luckimiute" [4, p. 136; 5]. They lived along the river and its tributaries, "from roughly the town of Rickreall south to Corvallis" [5]. Their neighbors were the Marys River people, the "Chapanafa (Mary's River) Kalapuyans," whose homeland took in present-day Corvallis [4, pp. 30, 137]. Disease, "probably malaria," struck the valley in 1831 and 1832 and killed a great many Kalapuyans [4, p. 72, citing Boyd 1990]. By 1841 only a few hundred were left in the whole valley: the thesis gives "barely 600" on p. 72 and "only 400 or so" on p. 191, both citing Wilkes 1845 [4].

On May 1, 1851, at Champoeg, three men spoke for the Luckiamute [4, pp. 136–137, citing Mackey 1974]. The record counts 44 people [4, p. 137; 5, quoting the Oregon Spectator of May 8, 1851: "the Luckiamukes number forty-four"]. Zybach's text has the three representing both the Chapanafa and the Luckymute. The Spectator, Jette, and the title of Zybach's Map 13 name the Luckiamute band alone; that map's caption names both nations [4, pp. 136–138; 5; 6]. The council record spells their names Daboe ("Jim"), Scho-la-que ("John") and Yuh-kow, which Zybach queries as "Nuh-kow?" [4, p. 137]. The Spectator calls the third man "Kone" [5]. The commissioners asked them to move east of the Cascade Mountains [4, p. 137; the commissioners are named in 6]. Scho-la-que answered that they "did not wish to leave the country where they had always lived" [4, p. 137, quoting the government record as printed in Mackey 1974]. The three signed an agreement to sell all of their territory, "including most of Benton and Polk Counties," for $20,000 [4, p. 137]. They were to keep a small reserve centered at present-day Airlie [4, p. 137, and Map 13, p. 138, after Gibbs and Starling 1851]. The Senate never ratified the agreement, so it never took effect [6]; Zybach writes that it "was later rescinded by the US Congress" [4, p. 137].

The treaty that took in this land is the "Treaty with the Kalapuya, etc., 1855," concluded at Dayton, Oregon Territory, and dated Jan. 22, 1855 [1]; this land lies within Royce cession 352, the cession of that date [3]. Joel Palmer, superintendent of Indian affairs, signed for the United States [1]. The citation is 10 Stat. 1143; the Kappler transcription prints "10 Stats., 1143" [1]. The treaty was ratified Mar. 3, 1855, and proclaimed Apr. 10, 1855 [1]. The original is Ratified Indian Treaty 282, National Archives Identifier 169820763 [2].

The preamble names a "Cheluk-i-ma-uke band," which Lewis identifies as the Luckiamute [1; 5]. Its signers are printed as "Dabo, or Jim, first chief"; "Sco-la-quit, or John, second chief"; and "Yah-kow, or Kompetine, third chief" [1]. The preamble also names a "Chep-en-a-pho or Marysville band" [1]. Marysville was renamed Corvallis in 1853, and the Confederated Tribes of Grand Ronde list a Mary's River band among this treaty's bands [4, p. 138; 8]. We read the two as the same people. (our reading; no source read for this report equates "Chep-en-a-pho" with the Marys River band in so many words; compare Zybach's "Chapanafa (Mary's River)," p. 30) Its signers are "Ah-mo, or George, first chief"; "Hinc-phor, or Hubbard, second chief" (preamble: "Himpher"); and "Oh-no, or Tim, third chief" [1]. All six signed in the first group, dated January 4, 1855 [1]. The last group, the "Santam bands of Calapooia" (preamble: "Santiam"), signed on January 22, the date the treaty carries [1]. Two of the 1855 Luckiamute names, Dabo and Sco-la-quit, closely match two of the 1851 names [1; 4, p. 137]. (our reading; Zybach suggests Scho-la-que "may be John Harris, 'Capt. Santiam,'" of the 1860 census, p. 137)

The bands ceded nearly the whole Willamette Valley [6; boundaries in 1, art. 1]. The treaty promised yearly payments for twenty years, starting at $10,000 a year [1, art. 2]. The bands engaged to remove to "the district which shall be designated for their permanent occupancy"; the article names no reservation [1, art. 1]. Jette describes this as the promise of a permanent reservation [6].

On March 14, 1855, two Polk County settlers, Isaac Zumwalt and Rice W. Simpson, made an agreement with the Luckiamute [5]. The band could live on about 25 acres of the two men's land claims [5]. The agreement runs its boundary past "the house occupied by Competine an Indian in his life time" [5, quoting the agreement]. Lewis writes that Kompetine, the treaty's third chief, is "likely the same Competine" [5]. The words "in his life time" suggest Competine had died by March 14, 1855; the identification is possible, not established. (our reading) Lewis places the 25 acres on the Luckiamute River between Pedee and Monmouth [5]. He works from the 1854 General Land Office maps of Township 9 South, Ranges 5 and 6 West; Range 6 West is this township [5]. He states that the mapped spot is assumed [5]. None of the neighboring claims in this part of the valley is a Zumwalt or Simpson claim. (our reading, from the patents for those claims) The two claims themselves have not yet been located on the survey maps, so the distance from that ground to this land is not known.

In the winter of 1855 and 1856 the valley's bands were forcibly removed to the Grand Ronde encampment [6]. The Luckiamute arrived between February and March 1856 [5]. Zybach dates the removal to 1855 [4, p. 137]. The 1856 Grand Ronde census lists John as principal chief of a Luckiamute band of 22 people [5]. President James Buchanan's executive order of June 30, 1857, established the Grand Ronde Reservation [7; 8].

Later rolls name individuals. Zybach's 1999 thesis on Soap Creek Valley, a sub-basin of the Luckiamute River, lists 45 of them in Appendix D, Table D.1 [4, abstract and pp. 249–251]. The names are from the Grand Ronde census rolls of 1860 and 1888 as compiled by Whitlow (1988) [4, pp. 250–251]. The table lists 27 under the heading "Chapanafa Nation" and 18 under "Luckymute Nation" [4, pp. 250–251]. Elsewhere the thesis explains these as the Mary's River and Luckiamute peoples [4, pp. 30, 136]. The thesis text calls the second roll 1880; the table heads it 1888, as does the title of Whitlow's compilation [4, pp. 229, 249–251]. The Luckiamute include Samanthy Wheeler, born about 1816; Peter Wheeler, "Luckiamute Pete"; and James Durbin, "Luckiamute Jim" [4, p. 251]. The Marys River people include William Barlow, "Marysville William," and George and Nancy Heartless [4, p. 250]. Sawala, "a possible son" of the two, was born about 1844 within the present city limits of Corvallis [4, p. 30]. His name was changed to William Hartless [4, p. 30]. The thesis calls him likely the "Unknown Heartless" of the 1860 census; the table's own entry reads "(unknown female)" [4, pp. 30, 250]. In 1913–14 Hartless dictated Mary's River Kalapuya myth texts to the anthropologist Leo J. Frachtenberg, at the Siletz Agency and at Chemawa [12: Hajda 1976, p. 7; Zenk 2006, note 6]. The thesis reprints one of them and dates that session to December 10, 1913, at the Chemawa Indian School [4, pp. 300–303]. Melville Jacobs edited and published the texts in Kalapuya Texts (1945), pp. 204–350 [12: Zenk 2006, note 6]. The list below gives all 45 names.

The Western Oregon Indian Termination Act, Public Law 588, passed in 1954 and took effect in 1956, ending the federal relationship with the Grand Ronde tribes [7]. The Grand Ronde Restoration Act, signed on November 22, 1983, restored it (25 U.S.C. 713 et seq.) [7]. The Confederated Tribes of Grand Ronde today list the Luckiamute and Mary's River bands among the bands of this treaty [8]. Their headquarters is at 9615 Grand Ronde Road, Grand Ronde, Oregon 97347 [8]. Their Cultural Resources Department, which includes the Historic Preservation Office, is at the Chachalu Museum and Cultural Center, 8720 Grand Ronde Road [8].

The Forest Service's Tribal Cession Lands record for cession 352 names two more present-day nations [3]. One is the Confederated Tribes of Siletz Indians, 201 SE Swan Avenue, Siletz, Oregon 97380 [9]. Its cultural program is at the Siletz Tribal Community Center, 402 Government Hill Road [9]. The Coast Reservation of 1855 was intended for the Coast, Umpqua and Willamette Valley groups, and the federal Siletz Agency stood on it [6; 7]. The other nation is the Confederated Tribes of Warm Springs, 1233 Veterans Street, Warm Springs, Oregon 97761 [10]. The sources read for this report do not explain the Warm Springs listing.

These 45 names are from the 1999 study, Appendix D, Table D.1, pages 250 and 251. [4] The study takes them from a 1988 compilation of the rolls. Names, spellings and the two headings are as the table prints them. The study explains "Chapanafa" as the Marys River people and "Luckymute" as the Luckiamute. The table gives two cautions: birth years are approximate and may be off by ten years or more, and a few people may be listed under more than one name.

The surveyors arrive

The earliest township plat for Township 9 South, Range 6 West, Willamette Meridian is dated May 1, 1855 and is recorded as an original cadastral survey; its digital derivative is a 1/4-scale image with a grid spacing of about 150 pixels.21 The Hutchinson field notes for Donation Land Claim 54 (pages 347–351) carry internal fieldwork dates of August 10–11, 1855, while the BLM index gives 1856 as the year surveyed; both are reported, with the discrepancy unresolved and the approval date of February 20, 1859 given as indexed.22 The BLM index attributes the Donation Land Claim 53 and 54 surveys to Thomas H. Hutchinson (indexed as 'T HTCHNSN'), with approval February 20, 1859; the claim plat of February 11, 1861 identifies both claims by reference to the first township plat approved on or after that date.23 Subdivision notes by Daniel Murphy are indexed to 1854 and to an approval of April 18, 1855; the index year and approval date should be compared against the field-note pages before being relied on.24 The bearing-tree register lists 23 trees at 13 corners (15 oaks, 2 alder, 2 ash, 2 cherry, 1 Douglas-fir, 1 willow); the reading is flagged as needing checking, with a second-reader comparison not yet made.25 The northwest corner of Donation Land Claim 54 is recorded near this land with a white oak of 20 inches bearing S 23° W at 23 links; the reading carries an unverified transcription status, and the exterior plat of June 15, 1854 is only near this land and not shown to be on it.26

First owners

The patent record gives John Johnson a patent of June 14, 1877 for 323.521 acres under the Oregon Donation Act (grant), described across Sections 27, 28, 33 and 34 as Donation Land Claim 53 in the Oregon City land office; the BLM collection does not hold every federal title record and a patent is a historical record, not current title.75 A companion patent of the same date names John W Tedrow and Rachel Tedrow for 322 acres in Section 33 as Donation Land Claim 54, under the same act (9 Stat. 496, September 27, 1850 act).76 Railroad grant patents to the Oregon and California Railroad Company cover 190.17 acres (Section 33 NWNW, January 30, 1897, under 14 Stat. 239) and 72.67 acres (Section 33 lots 2 through 4, November 29, 1899); the indexed subdivision labels for lots are as read and should be checked against the source image.77 A Homestead Entry patent to Charles W Pagett of October 12, 1900 covers 104.35 acres in Section 28 (SWSE and lots 5 and 6), citing 12 Stat. 392; the aliquot labels mix quarter and lot notation and need verification.78 The BLM historical index (file 090s060whwd.pdf, scanned June 17, 2006) has been saved but its patent entries, lieu selections and state grants are not yet read, so the chain of title remains incomplete.79 Geometry places the property outside Sections 16 and 36; the nearest school section is 13,539 feet away, but lieu selections recorded in the unread index could still bear on school-land status.80 Same-township patents (Gage 1866, Aldridge 1877, Taylor 1877, Whitlow 1879, Gilliam 1881, and the Oregon State lieu selection of 1872 covering 40,570.813 acres) are indexed as sharing sections with this land but are not shown to touch its outline.81
